ICONICS SAFE HARBOR STATEMENT

This website, document, file, or presentation may contain forward-looking statements that involve risks, uncertainties, and assumptions. All statements other than statements of historical fact could be deemed forward-looking statements, including without limit, any projections of revenues, gross margins, earnings, or other financial items; statements regarding strategies or plans for future operations; statements concerning new features, software in technical previews, enhancements, or upgrades to our existing applications or plans for future applications; statements relating to the expected performance or benefits of our offerings; statements about current or future economic conditions; and any other statements of expectation or belief. Because forward-looking statements relate to the future, they are subject to inherent uncertainties, risks, and changes in circumstances that are difficult to predict and many of which are outside of our control. Our actual results and financial condition may differ materially from those indicated in the forward-looking statements, and therefore you should not rely on any forward-looking statements that we may make.

The risks and uncertainties referred to above include, but are not limited to, competition, management of growth, development of the market for industrial software, market acceptance of our applications, breaches of our security measures, compliance with global laws and regulations, risks associated with maintaining a global business and global economic conditions, fluctuations in our operating results, interruptions or delays in the provision of our services, and risks associated with selling globally, through our regions and to larger enterprise customers. ICONICS assumes no obligation for, and does not intend to update, any forward-looking statements.

Any unreleased services, features, functionality, or enhancements referenced in a ICONICS document, roadmap, blog, website, press release, presentation, or public statement that are not currently available are subject to change at ICONICS discretion and may not be delivered as planned or at all. Customers who purchase our applications should make their purchase decisions based upon features and functions that are currently available based on our published price list.

Technical Preview – Features or releases that are labeled ‘Technical Preview’ are features that are not fully supported, may not be functionally complete, and are not suitable for deployment in production. However, these features are provided to the customer and to system integrators as a courtesy with their primary goal of exposing experimental and innovative technology to gain insights on how these can be applied in projects. During the development of a Technical Preview feature, additional components may become available to the public for testing in specific custom builds or released versions of the ICONICS platform. Suggestions and feedback are logged with features that are in technology preview. Bugs and anomalies are expected as it is not productized code; however, these specific items are not treated the same as other features that are in the product and most certainly do not fall any implied or explicit service level agreements in place.  It is the intention of ICONICS to further develop technical preview features in a future release, however, due to what we learn and unforeseen circumstances some of the technical preview features may get dropped from future releases and production support will not be made available. Technical preview features are explicitly called out in the ICONICS corporate safe harbor statement. This means that the customer should make purchasing decisions based off available features, which excludes technical preview features and releases. Please refer to the ICONICS safe harbor statement here: LINK to Website posting of our safe harbor statement.

Beta – Features or releases that are labelled ‘Beta Release’ are considered feature complete but contain several known or unknown bugs. These may also have speed or performance issues and may still cause crashes or data loss. The focus of beta features/releases is reducing impacts to the general user base by discovering with specific forward thinking customers what bugs are present that haven’t been accounted for and/or to further debug known bugs in customer environments. A beta feature or release has full intent to be released as a feature or a release and is suitable for customers to use in test environments and in certain cases production runtimes. A beta feature or release is at a development phase where it is committed by ICONICS and it can deliver its defined value and is feature complete; but it is not ready to be used by everyone in the customer base either due to scaling issues, bugs, lack of documentation, etc. Users of beta features or release may report any bugs that they find, and these will have the same level of severity and triage as released ICONICS software
